Terms and conditions

  1. Applicability

1.1 These Terms and Conditions apply to all offers of Knit13 and to all Knit13 agreements.

1.2 These Terms and Conditions may be waived only if this has been expressly agreed in writing and in which case the remaining provisions of these terms remain in force.

1.3 If the buyer also refers to its terms and conditions, these terms shall not apply unless expressly agreed by Knit13 in writing.

1.4 ‘Buyer’ means any visitor of the Internet site or any natural or legal person who is or will be in a contractual relationship with Knit13.

1.5 Knit13 reserves the right to adapt these terms to the legal standards of Belgium.

1.6 By using the Knit13 Internet Site and /or placing an order, the buyer accepts these Terms and Conditions as well as all other rights and obligations as stated on the Internet site.

1.7 To place an order, you must be at least 18 years of age. If you are under 18, we ask you to place the order by your parents or legal guardian. If we notice that an order is placed by a minor, we can reject this order.

1.8 Placing an order on the website shall be deemed to be acceptance of our general conditions of sale always available via the website

  1. Offers and conclusion agreements

2.1 Offers are valid while the yarns last.

2.2 An agreement is reached when an order confirmation has been handed to the buyer by e-mail or by mail has been sent to the buyer’s specified e-mail address or main address.

2.3 Buyer and Knit13 expressly agree that a valid agreement will be established by using electronic forms of communication as soon as the conditions set out in article 2.2 are met. The lack of a regular signature does not diminish the binding power of the sale. Knit13’s electronic files will, as far as the law allows, apply as a presumption of evidence.

2.4 Information, images, e-mail notices and applicability statements regarding key features of the products are given as accurately as possible by Knit13. However, derogations can in principle not give rise to damages and / or dissolution. Color and texture may differ on screen as in comparison to the product in natural light, this also does not give right to damage or dissolution.

2.5 We always describe as complete and accurate as possible what we sell and how the ordering process will proceed. However, to error is human and if we clearly made a mistake, we will not be required to deliver to you. If we use pictures, these are a true reflection of the offered goods and/or services.

  1. Prices

3.1 All prices are expressed in euros, in accordance with the legal requirements, and include sales tax.

3.2 The buyer owes the price that Knit13 has notified in an order confirmation in accordance with Article 2 of these Terms. Appropriate (manipulation) errors in the pricing, such as obvious inaccuracies, may also be corrected by Knit13 after the agreement has been created.

3.3 Delivery costs are not included in the price.

  1. Payment

4.1 Orders made via the internet site can be paid in the following ways: Credit card / Bancontact / Belfius Direct Net / KBC/CBC Payment Button / iDEAL /  Bank Transfer / SOFORT Banking / Bitcoin. The customer will have to make payment immediately while ordering. Otherwise Knit13 would not be able to manufacture the goods on time.

4.2 In case of non-timely payment or non-payment, the additional costs are always borne by the buyer.

4.3 At the expense of the buyer, all (extra) judicial costs of any kind which Knit13 has had to make of his (payment) obligations as a result of non-compliance by Knit13.

4.4 In the case of non-timely payment, Knit13 is authorized to terminate the agreement with immediate effect or suspend (further) delivery until the buyer has fully met the payment obligations, which may include payment of interest and costs due.

4.5 Without a valid payment order in the name of the registered card holder will not be accepted or processed. If the issuer of your card refuses to agree with your payment to us, we cannot be held responsible for delays in delivery and/or non-delivery of your order.

4.6 To purchase a product, add the product to your shopping basket. Afterwards enter your contact details and billing information. Then fill in your delivery address. In the last step you will get an overview page, you accept our terms and conditions and you confirm your payment by pressing the order button with the caption “order with payment obligation”. If you do these steps, your purchase is final.

  1. Delivery, delivery time and returns

5.1 Orders will be delivered as soon as possible, but consider a significantly longer delivery time than other webshops because our products are customized. All reported or stated delivery terms are an indication and do not result in any right or liability. In principle, Knit13 aims to send orders within 14 business days. If more items are ordered in your order and are not immediately available, these items will be reserved until your order is complete. The stated delivery period is for indicative purposes only and is never a fatal term. The maximum delivery time will be 30 days unless otherwise agreed. If this delivery time is not feasible, we will notify you by e-mail. You then have the right to dissolve the agreement. Already paid amounts are credited as soon as possible, but definitely credited within 30 days.

5.2 If a product made out of a yarn that is temporarily out of stock, is ordered by the buyer, it will be indicated when the product is available again. Delays will be notified to the buyer by email.

5.3 Delivery takes place on the address specified by the buyer during the purchase.

5.4 The risk of loss or damage to the product that is the subject of the agreement is transferred to the customer at the time when it is delivered to the customer legally and / or factually and in the customer’s capacity or by the customer designated third parties.

5.5 You need to check your delivery immediately upon receipt and notify us by return of any irregularities via email, or through the contact options via our website or by telephone. If we are not within the 24 hours after delivery have been advised of any damage, we assume that you have your order received in good order and we are not obliged to replace products or to refund.

5.6 When shipping abroad, different conditions may apply.

5.7 Shipping costs

All mentioned prices on Knit13 include VAT and exclude shipping costs. The possible shipping costs are automatically calculated by our system before payment is made. This, of course, differs by country of destination.

At Knit13, the following shipping costs apply:

– For orders within Belgium, you will pay 4 euros shipping cost.

If you order more than one designer piece, you will not pay any shipping costs.

– The shipping costs for products within Europe amount to 8 euros (Belgium excluded)

– Shipments outside of Europe amount to 12 euros.

The order will always be delivered to the address you have indicated as your billing address unless you have indicated differently at the time of the order.

If you have entered an incorrect address for delivery, then the additional shipping fee will be charged to you.

 5.8 Returns

 5.8.1 Return of products is only possible for non-customized products.

Knit13 however has no stock of products, every single garment is made to order. Non-customized products are products that you order without any option of customizing them; thus Knit13 does not sell this type of products. Since all garments are made to order and are tagged with a unique serial number all garments are customized according to the specific wishes of the costumer. Customized products exclude you from the right of withdrawal because they are clearly personal in nature.

  1. Exchange and revocation

6.1 The buyer is required to accurately inspect the products immediately after receipt.

6.2 Consumer purchases using electronic communications only means that the consumer buyer has the right to exercise a right of withdrawal without penalty and without giving reasons within fourteen business days after delivery of the product in question.

However, this right of withdrawal excludes products that:

– have been established according to buyer specifications;

– be clearly personal in nature;

Knit13 emphasizes that it provides unique pieces with a serial number only, with design, materials and size made to order according to buyer specifications.

6.3 If the consumer buyer has the right of withdrawal despite of the conditions mentioned in the previous paragraph, Knit13 is responsible for repayment within 30 days. This will happen minus the shipping costs.

  1. Retention of title

7.1 After full payment, the product is owned by the customer.

  1. Warranty and Liability

8.1 Knit13 warrants that the goods to be delivered comply with the usual requirements and standards that may be imposed on them and be free of any defects.

8.2 The proof of purchase is valid as proof of the warranty.

8.3 Knit13 is never held to pay any damages to the buyer or others unless there is intent or gross negligence on the part of Knit13. Knit13 is never liable for consequential or loss of business, indirect damage and sales loss.

8.4 If, for any reason, Knit13 is obliged to pay any damages, the damages will never exceed an amount equal to the invoice value relating to the product or service that caused the damage.

8.5 Without prejudice to the provisions of this article, there can be no guarantee if wear can be considered normal and further in the following cases:

– if any changes have been made in or to the product, including repairs not made with Knit13 or the manufacturer’s permission;

– if the original invoice cannot be consulted, has been changed or made illegible;

– defects resulting from non-destructive or improper use;

– damage caused by intentional gross negligence or negligence.

8.6 The buyer is obliged to indemnify Knit13 for any claim that third parties may apply to the contract against Knit13, in so far as the law does not prevent the damage and costs incurred by the buyer from being paid. The buyer is obliged to return the product to Knit13 so as to ensure a proper assessment and handling of the warranty claim. If a complaint is found to be well-founded, Knit13 undertakes to provide an equivalent product, unless otherwise agreed.

8.7 In addition to these warranty terms, statutory warranty terms remain valid.

Any arrangement offered by Knit13 as a guarantee does not affect the rights that the consumer can apply to Knit13 on the basis of the law and the remote agreement.

Any warranty granted by the manufacturer or the importer does not affect the rights the consumer can afford to the company under the law, the distance agreement and the company’s guarantee.

8.8 We hope, of course, that all our clients are 100% satisfied. If you still would have complaints about our services, you can contact us via We intend to reply to your complaint within 7 days. All agreements we conclude with our customers, regardless of their place of residence, are exclusively governed by Belgian law and in the event of any dispute, only the competent Belgian courts have jurisdiction. Where, for reasons of international law yet another law is applicable, for the interpretation of the current general conditions in the first place the Belgian market practices and Consumer Protection Law will apply.

  1. Mastery

9.1 In case of force majeure, Knit13 is not obliged to fulfill its obligations to the buyer, or the obligation is suspended for the duration of the force majeure.

9.2 Force majeure is understood to mean any circumstance which is independent of its sole purpose, thus preventing or fully obstructing its obligations towards the Buyer. Such conditions include strikes, fire, malfunctions, power failures, non-timely delivery of suppliers or other third parties involved. In addition, under force majeure is meant interference in a (telecommunications) network or connection or used communications systems and / or at any time not available on the Internet site.

  1. Intellectual Property

10.1 The buyer expressly acknowledges that all intellectual property rights of information, communications or other expressions relating to the products and / or the internet site relate to Knit13. Our website, logos, texts, photos, names and in general all our communication are protected by intellectual property rights which are either with us, or at our suppliers or other copyright holders. It is forbidden to make use of and/or to make changes to the intellectual property rights as described in this article. 10.2 Knit13 respects the intellectual property rights of others. We have a policy of removing user submissions that we feel violate copyright, trademark, or other intellectual property laws, suspending or blocking access to the design-saving or other features of our site to any user who uses our site in violation of any such law, and/or terminating in appropriate circumstances the account (if any) of any user who uses our site in violation of any such law.

  1. Conditions and requirements for customization of garments

11.1 You can submit your own materials, including photographs, illustrations, graphics and text, and/or select from a gallery of designs or images to create customized products. You may only submit materials for which you own all rights or you must have the authorization of the person who does own those rights.

11.2 Knit13 does not allow and cannot be held legally responsible for and retains the right not to produce any uploaded figure or design if that: (i) infringes, misappropriates or violates a third party’s patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or rights of publicity or privacy; (ii) violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability; (iii) is fraudulent, false, misleading or deceptive; (iv) is defamatory, obscene, pornographic, vulgar or offensive; (v) promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group; (vi) is violent or threatening or promotes violence or actions that are threatening to any other person; or (vii) promotes illegal or harmful activities or substances (including but not limited to activities that promote or provide instructional information regarding the manufacture or purchase of illegal weapons or illegal substances); (vii) is religious in nature.

12.1 Knit13 will only process the buyer’s data in accordance with its privacy policy. Knit13 hereby respects the applicable privacy rules and legislation.

13.1 All offers and agreements are subject to Belgian law only. In case of a dispute, only the courts of the District of Ghent have sole jurisdiction.

14.1 You can always ask Knit13 what data is being processed about you. To do this, you can send an email.
